Work-Related Mental Health Injuries in Victoria

If your mental health has been affected by your work — whether through stress, bullying, trauma, or a cumulative series of incidents — you may be eligible to make a WorkCover mental health claim in Victoria.

This guide walks you through the eligibility criteria, the claims process, and what psychology support looks like under a WorkCover claim.

Eligibility: Who Can Claim?

For mental injuries that occurred on or after 31 March 2024, WorkSafe says a compensable mental injury must:

  • Cause significant behavioural, cognitive or psychological dysfunction
  • Be diagnosed by a medical practitioner using the latest DSM
  • Be predominantly caused by employment

Different definitions or exceptions may apply to injuries before 31 March 2024.

What counts as a mental injury?

Work-related anxiety, depression, PTSD, adjustment disorder or other diagnosed mental injuries may be eligible where WorkSafeu2019s criteria are met.

Stress or burnout claims need careful assessment because WorkSafe excludes some claims where the injury is largely from usual or typical work stressors. The exclusion does not apply in the same way to traumatic events.

Important: Reasonable management exclusion

A mental injury may be excluded if it is caused wholly or predominantly by reasonable management action taken on reasonable grounds and in a reasonable manner. Examples can include performance management, disciplinary action, demotion or redundancy decisions, depending on the facts. If you are unsure whether this applies to your situation, speak with a WorkSafe agent or legal adviser.

The Claims Process Step by Step

  1. See your GP or treating doctor — Ask for a Certificate of Capacity. This officially records your injury and your capacity to work.
  2. Notify your employer — For mental injury claims, your employer must forward Part A of the claim form to their WorkSafe agent within 3 business days, then Part B and any certificates within 10 calendar days.
  3. Lodge your claim — A WorkCover claim form is submitted to your employer’s WorkSafe agent (e.g. EML, Gallagher Bassett, Allianz, Xchanging). The agent will usually make a claim decision within 28 days of receiving the claim.
  4. Provisional payments may begin — If your claim form or certificate of capacity shows a mental injury, you may be entitled to provisional payments for reasonable treatment and services for up to 13 weeks while your claim is assessed.
  5. Claim decision — If accepted: ongoing entitlements to treatment, weekly benefits and rehabilitation support may apply. If rejected: you may be able to dispute the decision through the Workplace Injury Commission (WIC).

Psychology Under a WorkCover Claim

Once your claim is accepted, or you are eligible for provisional payments, your WorkSafe agent can confirm psychology treatment approval. For approved WorkCover sessions at The Talk Shop, we bill the WorkSafe agent directly at approved fee schedule rates, so there is no out-of-pocket cost for eligible approved sessions.

WorkSafe-funded psychology must be provided by a WorkSafe-approved psychologist with general AHPRA registration. WorkSafe does not fund services delivered by provisional psychologists.

Psychology rates from 1 July 2026

  • 30-minute consultation: $104.36
  • 60-minute consultation: $208.70
  • 90-minute consultation: $313.05 where clinically appropriate and prior approval has been obtained from the WorkSafe agent
  • Group therapy (per person): $52.37

WorkSafe psychology requires a medical practitioner referral before treatment begins, and your WorkSafe agent must confirm your claim, provisional payments or treatment approval. We can help with WorkSafe billing paperwork once we have your claim number, agent details and referral.

Your Rights as an Injured Worker

  • You have the right to choose your own treating psychologist
  • You cannot be forced to attend treatment at a provider chosen by your employer
  • Your employer cannot access your clinical records without your consent
  • You are protected from adverse action for making a genuine WorkCover claim
  • If your claim is rejected, you can dispute the decision through the Workplace Injury Commission
